Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Clear Media Design, a Texas business ("we", "us"), for the use of Cap & Caption ("the Service"). By creating an account you agree to these Terms and our Privacy Policy.

1. Who can use the Service

You must be at least 18 years old and creating a book about a person for whom you are the parent, legal guardian, or have their consent (for adult subjects). You are responsible for ensuring any minor featured in your book is a person you have the right to document, and for obtaining consent from any other identifiable individual in a photo before uploading it.

2. Your account

Keep your login credentials confidential. You are responsible for activity on your account. Notify us at hello@capandcaption.comif you suspect unauthorized access.

3. Your content

You retain full ownership of the photos, story text, names, and other content you upload ("Your Content"). You grant us a limited, non-exclusive license to store, format, and print Your Content solely to operate the Service and fulfill any print order you place. We do not use Your Content for advertising, model training, or any purpose beyond running the Service for you.

You represent that you have the rights to Your Content and that it does not infringe anyone else's rights or violate applicable law.

4. Free tier and paid printing

Creating an account, saving entries, and previewing your book are free. There is no subscription. When you place a print order, you pay a one-time price — the current standard hardcover price is $74.99 USD, plus shipping. Prices, shipping speeds, and taxes are shown at checkout before you confirm.

5. Print orders, shipping, refunds

• Print orders are fulfilled by our print partner Lulu.
• Because each book is printed on demand with your unique content, an order that has entered production cannot be cancelled or refunded.
• If your book arrives damaged or with a printing defect, email hello@capandcaption.com within 30 days of delivery with photos, and we will reprint or refund at our discretion.
• Shipping times are estimates and depend on carrier performance and destination.

6. Acceptable use

You agree not to use the Service to:

• Upload sexual, violent, hateful, or otherwise unlawful content, or content depicting a minor in any such context.
• Upload content you do not have the right to use.
• Impersonate another person or misrepresent your relationship with the subject of your book.
• Attempt to access other users' accounts, data, or storage.
• Reverse engineer, scrape, or overload the Service.

We may suspend or terminate accounts that violate these rules. Serious violations, including any content that sexualizes a minor, will be reported to the appropriate authorities.

7. Availability

We aim for reliable uptime but do not guarantee the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time; if we discontinue the Service entirely we will give at least 60 days' notice and enable data export.

8. Termination

You can delete your account at any time from Settings. On deletion, your scrapbook, entries, and photos are permanently removed. Print-order records are retained as described in the Privacy Policy.

9. Disclaimers

The Service is provided "as is", without warranties of any kind, express or implied. We do not warrant that the Service will meet your expectations or that printed color reproduction will exactly match your screen.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) $100 USD. We are not liable for indirect, incidental, or consequential damages.

11. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to that jurisdiction.

12. Changes

We may update these Terms. Material changes will be emailed to account holders at least 14 days before taking effect. Continued use after the effective date means you accept the updated Terms.
